UNA legal update on COVID-19 Immunization Grievances Application

United Nurses of Alberta has updated its legal analysis of Alberta Health Services’ amended policy on the immunization of employees for COVID-19.

The Labour Relations Board has accepted an application from AHS for marshalling, which if adopted by the LRB would allow a LRB tribunal to hear human rights complaints related to the COVID immunization policy.

As a result, the LRB adjourned a planned February 22 meeting regarding UNA's Marshalling Application until they can provide notice to the human rights commission and complainants.

UNA continues to engage AHS with respect to moving these matters forward.

The legal analysis outlines UNA's view that Rapid Antigen Testing is not a substitute for immunization. UNA's position is the precautionary principle should apply and that immunization and RAT should both be required for all employees, unless there is an accepted accommodation based on a protected ground.
